Terms of Service

These Terms of Service (“Terms”) are an agreement between you and GoldenHour Gold LLC (“GoldenHour,” “we,” “us,” or “our”) governing your use of the GoldenHour app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 21 years old (or the legal drinking age in your jurisdiction, if higher) to use the Service. The Service provides information only and does not sell or serve alcohol. Always drink responsibly and follow applicable laws.

2. The Service

GoldenHour surfaces happy-hour and restaurant deal information for the Chicago area. We work to verify deals, but offerings, hours, prices, and availability are set by venues and can change without notice. The venue is always the final authority on its current deals. Deal information is provided “as is” for your convenience.

Some venues pay for promoted placement in the Service. Promoted listings are labeled as such. Paid promotion is separate from deal verification and does not affect whether a deal is verified.

3. Accounts

You are responsible for the accuracy of your account information and for keeping your credentials secure and all activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions & Billing

GoldenHour+ is an auto-renewing subscription billed through our payment processor (currently Stripe). Your subscription is purchased directly from GoldenHour Gold LLC, and all billing, cancellations, and refunds are handled by us through Stripe, not by Apple or any app store.

• If a free trial is offered, your paid subscription begins automatically when the trial ends unless you cancel before then.
• Subscriptions renew at the then-current price until canceled. You can cancel anytime via the Stripe customer portal; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable for partial periods.
• We may change subscription pricing prospectively, with notice before the change applies to you.

5. User Content

You retain ownership of photos, captions, ratings, and other content you submit (“User Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content within the Service, and to use it to promote the Service (for example, on our website or social media), with attribution where practicable. You represent that you have the rights to your User Content and that it does not violate any law or third-party right.

You agree not to post content that is unlawful, infringing, deceptive, harassing, hateful, or that misrepresents a venue or deal.

6. Acceptable Use

You agree not to:

• Violate any law or the rights of others;
• Scrape, reverse-engineer, or disrupt the Service or its infrastructure;
• Submit false deals or impersonate a venue or person;
• Attempt to access accounts or data that are not yours.

We may moderate, remove content, and suspend or terminate accounts that violate these Terms. You can report or block content and users within the app.

7. Copyright Complaints

If you believe content on the Service infringes your copyright, email us at support@goldenhourgold.com with (a) a description and link or screenshot of the content, (b) proof of your ownership or authority to act for the owner, and (c) your contact information. We will review promptly and remove infringing content. We may terminate accounts of repeat infringers.

8. Third-Party Services

The Service relies on third parties including Supabase, Stripe, Expo, Google, and Apple. Your use of those services may be subject to their own terms and policies. We are not responsible for venues, their offerings, or other third-party services or links.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that deal information is accurate, complete, or current, or that the Service will be uninterrupted or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDENHOUR GOLD LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide notice in the app. Continued use after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Cook County, Illinois, unless otherwise required by applicable law.
